Matrimonial

We have extensive experience of advising on the financial aspects of ancillary relief and children's act matters.  We can provide valuation evidence on the family business and the ability to extract funds from the business to assist with the financial settlement or on-going maintenance requirements.  Our team have regularly lectured to solicitors on the financial aspects of matrimonial matters, and take an active interest in the field.

 

Examples

We were appointed to act as a single joint expert dealing with the valuation of a group of connected companies in the construction industry where tax planning schemes had been put in place.  As a result of the report we were able to arrive at a value of the company accepted by the Court and also able to demonstrate how and what funds were available for distribution to the shareholders.

 

Acting as single joint expert, we were instructed to prepare a valuation report on a company where there was an ongoing Special Civil Investigation HMRC enquiry relating to the company and personal affairs of the directors.  By working to anticipate the outcome of the enquiry we were able to prepare a valuation report and also consider matters relating to liquidity which allowed the matrimonial proceedings to be settled without waiting for the outcome of the enquiry.

 

We were instructed by one party to review a valuation of a distribution company prepared by a single joint expert where the value was believed to be incorrect.  After a thorough review and with the co-operation of the company we successfully argued that the value of the company should be increased from £21 million to £25 million.
